Litigation is a confrontational process which by its very nature pits one party against the other. This results in increased anxiety and trauma for the couple as well as their children, who are invariably damaged in the divorce process. The expeditious and effective mediation process invariably reduces the conflict and consequentially the emotional trauma experienced by the family and hence reduces the bitterness and resentment of the parties’ post divorce. This augers well for the future, particularly insofar as there are minor children involved given that the parents will be required to act as co-holders of parental rights and responsibilities in respect of their children, notwithstanding that they are divorced.
